Ajit Pawar, the former Deputy Chief Minister of Maharashtra, has filed a petition in the Supreme Court challenging his disqualification from the state Assembly.
Pawar was disqualified by the Maharashtra Assembly Speaker on June 29, 2023, after he was found to have violated the anti-defection law by resigning from the Nationalist Congress Party (NCP) and joining the Bharatiya Janata Party (BJP).
Pawar’s petition argues that the Speaker’s decision was “arbitrary and mala fide” and that he was not given a fair hearing.
The petition also argues that the Speaker’s decision is inconsistent with the Supreme Court’s ruling in the _Kishore Samrite_ case, which set out the criteria for disqualifying a legislator under the anti-defection law.
Pawar’s petition is likely to be heard by the Supreme Court soon.
